According to an from the Corps commandant’s Staff Judge Advocate that was obtained by the AP, the Marines now “interpret a spouses club’s decision to exclude a same-sex spouse as sexual discrimination because the exclusion was based upon the spouse’s sex.” The Marines Corps’s move comes in response to a still-unresolved controversy at the North Army base Fort Bragg, where a same-sex spouse was denied access to an officers’ spouses club. The Pentagon later told BuzzFeed’s Geidner that the spouses club is independent of the Department of Defense, and the Association of Bragg Officers’ Spouses issued a statement saying that it would “review the issue” at a board meeting. The events that unfolded at Fort Bragg underscore the challenges that remain for the military in a post-DADT world where DOMA is still the law of the land: service members serve openly, but they and their partners have no official protections against discrimination on the basis of their sexual orientation. The fate of DOMA at the Supreme Court, of course, would have a big impact on these issues. But there are steps that the military can and should take before then to protect the dignity of all its employees, be they or straight, married or partnered.
